Today, 31 March 2021, the Appeals Chamber of the International Criminal Court ("ICC" or "Court") delivered its judgment on the Prosecutor's appeal against Trial Chamber I's decision of 15 January 2019, which had acquitted, by majority, Mr Gbagbo and Mr Blé Goudé of all charges of crime against humanity allegedly committed in Côte d'Ivoire in 2010 and 2011. On Wednesday 31 March 2021 at 15:00 (The Hague local time), the Appeals Chamber of the International Criminal Court (ICC) will deliver its judgment on the Prosecutor's appeal against the acquittal decision in the case The Prosecutor v. Laurent Gbagbo and Charles Blé Goudé.
The Blé Goudé case and Gbagbo case were joined on 11 March 2015. The trial began on 28 January 2016. On 15 January 2019, Trial Chamber I, by majority, acquitted Mr Laurent Gbagbo and Mr Charles Blé Goudé from all charges of crimes against humanity allegedly committed in Côte d'Ivoire in 2010 and 2011. On 1 February 2019, the Appeals Chamber set conditions to be imposed on Mr Gbagbo and Mr Blé Goudé upon their release to a State willing to accept them on its territory and willing and able to enforce the conditions set by the Chamber. On 16 July 2019, Trial Chamber I filed the written full reasons for the acquittal of Mr Laurent Gbagbo and Mr Charles Blé Goudé. On 16 September 2019, the Prosecutor filed a notice of appeal against this decision.
On 31 March 2021, the Appeals Chamber confirmed, by majority, the acquittal decision of 15 January 2019.
Next steps: The acquittal of Mr Gbagbo and Mr Blé Goudé is now final. The Appeals Chamber revoked all conditions on the release of Mr Gbagbo and Mr Blé Goudé. The Chamber directed the ICC Registrar to make arrangements for the safe transfer of Mr Gbagbo and Mr Blé Goudé to a receiving State or States.

From 22 to 24 June 2020, the Appeals Chamber of the International Criminal Court ("ICC" or "Court") will hold a partially virtual hearing in the case of The Prosecutor v. Laurent Gbagbo and Charles Blé Goudé to hear the observations of Parties and Participants on the Prosecutor's appeal against the acquittal decision in this case. The Chamber will make its judgment on this appeal at a later stage.
Today, 28 May 2020, the Appeals Chamber of the International Criminal Court ("ICC" or "Court") decided to dismiss the request of the Defence for Mr Gbagbo for reconsideration of its judgment granting him and Mr Blé Goudé conditional release. The Appeals Chamber however decided to review the conditions of release. This decision does not concern the appeal against the decision acquitting Mr Gbagbo and Mr Blé Goudé.
The Appeals Chamber of the International Criminal Court (ICC) will hold a hearing on 6 February 2020 (potentially extending to 7 February) to hear observations on the application of Mr Laurent Gbagbo of 7 October 2019, requesting the Appeals Chamber to reconsider its judgment of 1 February 2019 which imposed conditions on the release of Mr Laurent Gbagbo and Mr Blé Goudé following their acquittal.
On 15 January 2019, Trial Chamber I of the International Criminal Court ("ICC" or "Court"), by majority, Judge Herrera Carbuccia dissenting, issued an oral decision acquitting Mr Laurent Gbagbo and Mr Charles Blé Goudé from all charges of crimes against humanity allegedly committed in Côte d'Ivoire in 2010 and 2011.
We note the decision of the Appeals Chamber. The Prosecution's position was that we would be amenable to release with a set of conditions attached. These conditions would be to ensure that Messrs Laurent Gbagbo and Charles Blé Goudé would be available before the Court should the trial proceedings against them continue.
