ICC Prosecutor Karim A.A. Khan KC on the conviction of Mr Al Hassan Ag Abdoul Aziz Ag Mohamed Ag Mahmoud
I welcome today’s conviction of Mr Al Hassan Ag Abdoul Aziz Ag Mohamed Ag Mahmoud, an official of the police of Ansar Eddine and Al Qaeda in the so-called Islamic Maghreb, for war crimes and crimes against humanity committed in Timbuktu, Mali, when it was under the control of those armed groups between April 2012 and January 2013.
Based on the evidence presented by my Office in the course of a fair and impartial trial, the independent judges of the International Criminal Court were satisfied that Mr Al Hassan's criminal culpability was established beyond reasonable doubt for a number of charges brought.
Mr Al Hassan’s conviction marks a significant step toward holding accountable those most responsible for atrocities committed against the civilian population in Timbuktu and in the region.
This is an important moment for the International Criminal Court and for my Office. It is the first time an accused has been prosecuted and convicted for religious persecution, and for the passing of sentences without due process.
The guilty verdict delivered today across multiple charges, such as mutilation and torture, acknowledges the suffering endured by the local population of Timbuktu, including many young girls and women. It is my hope that this moment brings a sense of justice, of some solace, for those victims whose rights have been vindicated today.
It is also my prayer that this trial, this verdict, will strengthen the collective resolve of the international community to end impunity for atrocity crimes globally which continue unabated in far too many parts of the world today.
The Office will now carefully study the judgement, including with respect to the gender persecution charge presented by the Office in proceedings, with the view to deciding any potential further action.
This case could only take place because of the variety of actors who have contributed, each in their own way. I am immensely grateful to the Malian authorities who, from the start, provided essential assistance to my Office in collecting evidence, and other types of support they so generously gave. I also want to include all the other states that have helped us, that have worked together with us, that have collaborated and built a partnership so we could discharge our mandate. And I also wish to recognise the United Nations for their constant and significant contribution to our work.
Finally, and most importantly, I want to express my gratitude and my admiration for victim groups and for civil society organisations for their focus, for their stamina, for their commitment, and for their partnership in walking this path with us together towards accountability. This day is a testament to their work. Thank you.
My Office continues its work today across all situations within our jurisdiction. We work so we can deliver justice for all those affected by international crimes - justice that has been felt here today. This joint commitment, this insistence that justice is a right for all is how we demonstrate, tangibly and clearly, that all lives have equal value.

أرحب بالإدانة التي صدرت اليوم بحق السيد الحسن آغ عبد العزيز آغ محمد آغ محمود، وهو مسؤول في شرطة أنصار الدين وتنظيم القاعدة في ما يسمى ببلاد المغرب الإسلامي، بتهمة ارتكاب جرائم حرب وجرائم ضد الإنسانية في تمبكتو، بمالي، عندما كانت تحت سيطرة تلك الجماعات المسلحة في الفترة من نيسان/أبريل 2012 إلى كانون الثاني/يناير 2013.
استنادا إلى الأدلة التي قدمها مكتبي في سياق محاكمة عادلة ونزيهة، اقتنع القضاة المستقلون في المحكمة الجنائية الدولية بأن المسؤولية الجنائية للسيد الحسن قد ثبتت بما لا يدع مجالا للشك في عدد من التهم الموجهة إليه.
تُمثل إدانة السيد الحسن خطوة مهمة نحو مساءلة الأشخاص الأكثر مسؤولية عن الفظائع المرتكبة ضد السكان المدنيين في تمبكتو وفي المنطقة.
هذه لحظة مهمة للمحكمة الجنائية الدولية ولمكتبي. فهي المرة الأولى التي تتم فيها محاكمة متهم وإدانته بتهمة الاضطهاد الديني، وإصدار أحكام دون مراعاة الإجراءات القانونية الواجبة.
إن الحكم الصادر اليوم بالإدانة بتهم متعددة مثل التشويه والتعذيب هو اعتراف بالمعاناة التي تحملها السكان المحليون في تمبكتو، بمَن فيهم العديد من الفتيات والنساء. ويحدوني الأمل في أن تجلب هذه اللحظة شعورا بالعدالة وبعض العزاء للمجني عليهم الذين تم الدفاع عن حقوقهم اليوم.
كما آمل أن تؤدي هذه المحاكمة، وهذا الحكم، إلى تعزيز التصميم الجماعي للمجتمع الدولي على إنهاء الإفلات من العقاب على الجرائم الوحشية على مستوى العالم، التي لا تزال مستمرة بلا هوادة في أجزاء كثيرة جدا من العالم اليوم.
سيقوم المكتب الآن بدراسة الحكم بعناية، بما في ذلك تهمة الاضطهاد الجنساني التي قدمها المكتب في الإجراءات، بهدف اتخاذ قرار بشأن أي إجراء آخر محتمل.
ولم يكن لهذه القضية أن تتم لولا تنوع الجهات الفاعلة التي ساهمت فيها، كل منها بطريقتها الخاصة. وأنا ممتن للغاية للسلطات المالية التي قدمت، منذ البداية، المساعدة الأساسية لمكتبي في جمع الأدلة، وأنواع أخرى من الدعم الذي قدمته بسخاء. وأود أيضا أن أشمل جميع الدول الأخرى التي ساعدتنا، والتي عملت معنا، والتي تعاونت وأقامت شراكة حتى نتمكن من الاضطلاع بولايتنا. وأود أيضا أن أعرب عن تقديري لمساهمة الأمم المتحدة المستمرة والهامة في عملنا.
وأخيرا والأهم من كل ما سبق، أود أن أعرب عن امتناني لمجموعات المجني عليهم ومنظمات المجتمع المدني وإعجابي بها وبتركيزها، وقدرتها على التحمل، والتزامها، وشراكتها في السير معنا على هذا الدرب نحو المساءلة. وهذا اليوم هو شهادة على عملها. شكرا.
