Assembly of States Parties concludes its eighth session
On 26 November 2009, the Assembly of States Parties to the Rome Statute of the International Criminal Court (“the Assembly”) adopted resolutions on several issues, including the Review Conference of the Rome Statute, the establishment of an independent oversight mechanism, the establishment of a liaison office at the African Union Headquarters, the permanent premises of the Court and the programme budget for 2010.
The Assembly decided that the Review Conference would be held in Kampala, Uganda, from 31 May to 11 June 2010, for a period of 10 working days to consider:
a) The possible deletion of article 124 of the Statute, which allows a new State Party to opt for excluding from the Court’s jurisdiction war crimes allegedly committed by its nationals or on its territory for a period of seven years;
b) The definition of the crime of aggression, the conditions for the exercise of jurisdiction by the Court, as well as draft elements of the crime;
c) The inclusion of the employment of certain poisonous weapons and expanding bullets in the definition of war crimes in article 8 of the Statute.
Furthermore, the Review Conference would conduct a stocktaking of international criminal justice focusing on four topics: complementarity, cooperation, the impact of the Rome Statute system on victims and affected communities, and peace and justice.
The Assembly also decided to establish a working group for the purpose of considering the remaining proposals for amendments as from its ninth session in 2010.
The Assembly further decided to establish an independent oversight mechanism, pursuant to article 112, paragraph 4, of the Rome Statute, with an initial mandate to provide an investigative capacity for the Court to address alleged misconduct of elected officials and staff. Further elements of oversight envisaged in the Statute, including inspection and evaluation, are expected to be considered by the Assembly at its ninth session.
As regards the permanent premises of the Court, the Assembly adopted a resolution wherein it took note of the decision of the Oversight Committee that the architectural design contract should be awarded to Schmidt Hammer Lassen Architects, subject to satisfactory negotiations on the terms and conditions of the contract with the selected design team.
As regards family visits for indigent detainees, the Assembly decided that the Court may, on a temporary basis, partly or fully subsidize family visits for indigent detainees up to an amount to be determined by the Assembly in the context of the approval of the programme budget, pending the establishment of a voluntary system of funding family visits.
The Assembly decided to establish a liaison office at the headquarters of the African Union in Addis Ababa.
The Assembly also approved a budget of approximately € 103,600,000 for 2010 and a staffing level of 768. The threshold for the Contingency Fund was set at € 7 million; below that level, the Assembly would consider its replenishment.
The Assembly decided to hold a resumption of its eighth session between 22 and 25 March 2010 at United Nations Headquarters in New York for the purpose of preparing for the Review Conference, in particular on the issue of stocktaking, as well as to hold its ninth session in New York for a period of five working days as early as possible in December 2010.

La Asamblea de Estados Partes en el Estatuto de Roma de la Corte Penal Internacional (“la Asamblea”) adoptó, el 26 de noviembre de 2009, resoluciones sobre distintas cuestiones que incluían la Conferencia de Revisión del Estatuto de Roma, el establecimiento de un mecanismo de supervisión independiente, la puesta en funcionamiento de una oficina de enlace en la sede de la Unión Africana, los locales permanentes de la Corte y el presupuesto por programas para 2010.
La Asamblea decidió que la Conferencia de Revisión se celebrará en Kampala, Uganda, desde el 31 de mayo al 11 de junio de 2010, durante un periodo de 10 días laborables con el fin de considerar:
a) la posible eliminación del artículo 124 del Estatuto, que permite a un nuevo Estado Parte optar por excluir la jurisdicción de la Corte sobre presuntos crímenes de guerra cometidos por nacionales de ese Estado, o en su territorio, durante un período de siete años:
b) La definición del crimen de agresión, las condiciones del ejercicio de la jurisdicción por la Corte, así como el proyecto de elementos de los crímenes;
c) La inclusión del empleo de ciertas armas envenenadas y de balas que se ensanchan en la definición de crímenes de guerra del artículo 8 del Estatuto.
Además, la Conferencia de Revisión llevará a cabo un balance de la justicia penal internacional centrándose en los siguientes cuatro temas: complementariedad, cooperación, el impacto del sistema puesto en pie por el Estatuto de Roma sobre las víctimas y las comunidades afectadas, y paz y justicia.
La Asamblea también decidió establecer un grupo de trabajo con el fin de examinar las restantes propuestas de enmienda a partir de su noveno período de sesiones en el año 2010.
La Asamblea decidió, además, establecer un mecanismo de supervisión independiente, de acuerdo con el párrafo 4 del artículo 112 del Estatuto de Roma, con el mandato inicial de dotar a la Corte de una capacidad investigadora que le permita enfrentarse a las acusaciones de presuntas conductas impropias por parte de los funcionarios elegidos de la Corte Penal Internacional y de los funcionarios que estén sujetos al Estatuto del Personal de la Corte. Otros elementos de control previstos en el Estatuto, tales como las funciones de inspección y evaluación, serán previsiblemente examinados por la Asamblea durante su noveno período de sesiones.
En cuanto a los locales permanentes de la Corte, la Asamblea adoptó una resolución en la que tomó nota de la decisión del Comité de Supervisión según la cual se debería encargar el proyecto de diseño arquitectónico a Schmidt Lassen Architects, siempre y cuando se produzca una negociación satisfactoria de los términos y condiciones del contrato con el equipo de diseño seleccionado.
Por lo que respecta a las visitas de familiares a detenidos indigentes, la Asamblea decidió que la Corte podrá, de manera temporal, subvencionar total o parcialmente las visitas familiares a detenidos indigentes hasta un límite máximo que será fijado por la Asamblea en el contexto de la aprobación del presupuesto por programas, y a la espera del establecimiento de un sistema de financiación voluntario de visitas de familiares.
La Asamblea decidió establecer una oficina de enlace en la sede de la Unión Africana en Adis Abeba.
La Asamblea también aprobó un presupuesto de aproximadamente €103.600.000 para 2010 y una plantilla de 768 personas. El umbral para el Fondo de Contingencia se estableció en €7 millones, por debajo del cual la Asamblea habrá de considerar su reabastecimiento.
La Asamblea decidió celebrar una continuación de su octavo período de sesiones entre el 22 y el 25 de marzo de 2010 en la sede de las Naciones Unidas en Nueva York, con el objeto de preparar la Conferencia de Revisión, y, en particular, el balance de la justicia penal internacional, así como celebrar su noveno período de sesiones en Nueva York durante un período de cinco días laborables tan pronto como sea posible dentro el mes de diciembre de 2010.
